Who you are contracting with
Notix operates and is responsible for this site and the Notix application. Notix is an independent product, operated on its own behalf.
Eligibility and accounts
You may use the site and product only if you can form a binding contract with Notix and are not barred from doing so under applicable law. You are responsible for the security of your account credentials, for your API keys, and for all activity under your account.
Acceptable use
You agree not to misuse the site or product. You may not:
- Violate any applicable law or regulation.
- Infringe the rights of others or violate their privacy.
- Interfere with or disrupt the service or its infrastructure.
- Transmit malicious code, unsolicited bulk mail, or prohibited content.
Anti-spam enforcement
Sending unsolicited marketing email through Notix damages the deliverability of every other customer on the platform, so it is enforced strictly. Marketing sends must use double opt-in verification. Accounts that bypass double opt-in, or that use the transactional API for promotional campaigns, may be suspended or terminated without notice.
Your content and your recipients
You own the email content, templates and contact data you bring to Notix. You are responsible for having a lawful basis to email every recipient you upload, and for honouring unsubscribes. Notix processes that data on your behalf as described in the Privacy Policy.
Plans and fees
Notix offers a Free plan and paid plans. The current plans, prices and monthly limits are on the pricing page at usenotix.dev/pricing. Today they are:
- Free: no charge. Up to 5,000 emails a month and 200 a day.
- Pro: $15 a month for 50,000 units.
- Scale: $35 a month for 100,000 units.
- Business: $75 a month for 300,000 units.
Paid plans are billed monthly in advance. You can pay by card in US dollars, or from a prepaid Notix wallet in US dollars, Nigerian naira or Kenyan shillings. Wallet prices in naira and shillings are set by Notix and shown in the dashboard before you pay. Wallet top-ups are prepaid and not refundable. The wallet balance can pay for plans, pay-as-you-go and SMS.
Published prices exclude taxes unless stated otherwise.
A team admin can change plan or cancel at any time in the dashboard.
- Upgrade: takes effect at once. You pay a prorated charge for the rest of the current billing period, and the bigger plan’s units apply straight away.
- Downgrade, or a move to Free: takes effect at your next renewal. Until then you keep your current plan and its units.
- Cancellation: takes effect at the end of the current billing period.
Nothing in your account is deleted when you change plan or move to Free.
Units
Paid plans count sending in units.
- A marketing email is 1 unit.
- A transactional email is 0.5 of a unit.
Broadcasts, automations and any email you mark as marketing (for example with type: "MARKETING" in the API) are marketing emails. Other emails sent through the API or SMTP are transactional. We count each email when it is sent. Emails that bounce or are not delivered still count, because they were sent. Notix’s free welcome send does not count. Contacts, contact books and suppression entries are never counted.
You must not label marketing email as transactional to use fewer units. Doing so is a breach of these Terms and of the Anti-spam enforcement section.
Your monthly limit
Each paid plan includes a number of units for each billing month. Unused units do not carry over.
When your team has used all its units, Notix stops sending your email until your units reset at the start of the next billing month, unless pay-as-you-go is on. While sending is stopped:
- emails already accepted are held and sent once sending resumes;
- broadcasts and automations pause;
- new sends through the API or SMTP are refused or deferred.
Sign-in and verification codes sent through Notix keep being sent after the limit, up to a daily ceiling of 1% of the plan's monthly units or 500, whichever is higher (today 500 a day on Pro, 1,000 on Scale and 3,000 on Business). Past that ceiling they stop until the next day. They still count as units.
We tell your team admins by email and in the dashboard when you reach 80% and 100% of your units. Stopping at the limit is not an outage and does not count against the Service level commitment.
The Free plan stops sending when it reaches its daily or monthly limit. It has no pay-as-you-go.
Pay-as-you-go
Pay-as-you-go lets a paid plan keep sending after it has used all its units. It is off unless a team admin turns it on.
Consent. Only a team admin can turn pay-as-you-go on or off, and only in the Notix dashboard. It cannot be turned on through the API, an SDK or the MCP server. When a team admin turns it on, the dashboard shows the price and asks them to confirm. By confirming, the team admin agrees, on behalf of the team, to pay for all sending past the plan’s units while pay-as-you-go is on. Every team admin receives an email each time it is turned on or off, as a record.
If your team was already paying for sending past its units before these Terms applied to it, pay-as-you-go starts on for your team. We tell your team admins at least 30 days before, and any team admin can turn it off with one click.
Price. Sending past your units costs $1 per 1,000 marketing emails and $0.50 per 1,000 transactional emails ($0.001 a unit), or the wallet price in naira or shillings shown in the dashboard. There is no spending cap. You are responsible for watching your usage, which the dashboard and the API show at any time.
Billing.
- If you pay by card, extra sending is billed in arrears on your next monthly invoice.
- If you pay from your wallet, extra sending is charged to your wallet each day. If the wallet cannot cover it, sending past your units stops until you top up.
You pay only for sending past your units, and only while pay-as-you-go was on. Turning it off stops extra sending from then on. Email accepted while it was on is still sent and billed.
Pay-as-you-go is paused during a free month of Pro and while a payment for your plan is overdue. While it is paused, sending stops at your units.
Changes to prices
We may change our plans and prices. For an existing paid team, we will give at least 30 days’ notice by email before a price or plan change applies to it. If you do not agree, you can cancel or change plan before the change applies.
The pricing described in these sections applies to a team that was already on a paid plan when it was published only after that 30-day notice period ends.
Intellectual property
The Notix name, logo and marks belong to Notix Labs Limited. You may not use them without prior written permission. These Terms cover the hosted service and grant no rights in the software behind it.
Service level
For teams on a paid plan, Notix commits to 99.9 percent monthly availability of the sending API and the SMTP relay, measured by the public status page at app.usenotix.dev/status. Scheduled maintenance announced at least 24 hours ahead, and outages caused by your configuration, your DNS, or third-party services we do not control, are excluded. If availability in a calendar month falls below 99.9 percent, you may claim a credit of 10 percent of that month’s subscription fee, or 25 percent if it falls below 99 percent, by writing to hey@usenotix.dev within 30 days of the end of that month. Credits are applied to a future invoice and are the sole remedy for availability shortfalls. The Free plan is provided on a best-effort basis without this commitment.
Third-party services
Notix relies on infrastructure providers to deliver mail and links to services we do not control. We are not responsible for the content or practices of third-party sites.
Disclaimer
The site and product are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, except for the availability commitment set out under Service level above.
Limitation of liability
To the fullest extent permitted by law, Notix is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenue.
Indemnification
You agree to indemnify and hold Notix harmless from claims, damages, liabilities and expenses arising out of your use of the site or product, the mail you send through it, or your breach of these Terms.
Changes and availability
We may modify these Terms and change the site or product. Changes to prices or plans for paying customers take effect after the notice period in Changes to prices. Other changes take effect when posted. We may suspend or discontinue the service in whole or in part.
Governing law
These Terms are governed by applicable law without regard to conflict-of-law principles. Where required, disputes are subject to the courts of your place of residence or as otherwise mandated by law.
